Entry process
- The promotion is open to residents of Great Britain (excluding Northern Ireland), the Isle of Man and the Channel Islands only. Excluding employees of Whyte & Mackay and their immediate families, their agents or anyone else professionally connected with the promotion.
- Participants must be 18 years or over.
- Promotion opens on 14.03.17 and closes for applications on 11.59pm on 02.05.2017 (“the Promotional Period”).
- The prize is a trip for two (both 18 or over) to one of the British & Irish Lions vs. The All Blacks Test Matches in New Zealand as well as travel and accommodation for 7 nights(“the Prize”). Additional prizes may also be won.
- Consumers can only enter the competition by purchasing a promotional 70cl or 1 litre bottle of Whyte & Mackay Blended Scotch Whisky (“the Product”) and entering the unique 10-digit promotional code, located on the back of the promotional neck collar via the link at the top of the main home page of whyteandmackay.com. Claimants must complete all required fields on the form online – there are 3 stages. See information about promotional codes below.
- Fields to be completed include;
- Step 1 – Unique code
- Step 2 – Title, first name, surname, date of birth, house number, street name, town/city, postcode, email, confirm email
- Step 3 – Test match date availability, jersey size, 3 marketing questions, opt in and agree to terms and conditions
- One chance to enter per unique code. Unique codes must only be acquired from purchasing the Product.
- Online entries only will be accepted. Entries via post, social media and telephone will not be accepted.
THE PRIZE DETAILS
- (i) The Prize is for one winner and one guest only (both to be 18 years old or over) and shall be selected from one of the following 3 Prize packages:
Package 1
- Return economy flights from London Heathrow airport, departing on 18June 2017 to Auckland Airport, New Zealand, arriving 20 June 2017 and departing Auckland Airport on 27June 2017
- Staying at the Sky City Hotel for seven nights.
- A pair of tickets to the First Test British and Irish Lions v New Zealand All Blacks at Eden Park, Auckland on Saturday 24th June 2017.
Package 2
- Return economy flights from London Heathrow airport, departing on 26 June 2017 to Wellington Airport, New Zealand, arriving on 28 June 2017 and departing Wellington on 5 July 2017
- Staying at Thorndon by Rydges for seven nights.
- A pair of tickets to the Second Test British and Irish Lions v New Zealand All Blacks at Westpac Stadium, Wellington on Saturday 1 July 2017.
Package 3
- Return economy flights from London Heathrow airport, departing on 2 July 2017 to Auckland Airport, New Zealand, arriving 4 July and departing Auckland on 11 July 2017
- Staying at the Sky City Hotel for seven nights.
- A pair of tickets to the Second Test British and Irish Lions v New Zealand All Blacks at Eden Park, Auckland on Saturday 8 July 2017.
- Accommodation is at 4* hotel sharing a twin room on a bed and breakfast basis;
- Only one package can be selected by the winner. This must be done as part of the entry process.
- Winners cannot change the package they select after submitting their entries and the Prize is not transferable.
- The winner shall be given £500 spending money;
- A valid credit card will be required to check into accommodation and will be used to guarantee any incidentals such as in-room calls or services;
- Specified accommodation is subject to availability at the time of booking. Alternatives may be offered dependent on availability;
- Airline seats are subject to availability and the winner and their guest must abide by and be subject to the Airline's published Conditions of Carriage;
- The winner and their guest must travel together to and from New Zealand;;
- Once flight tickets have been issued, they are only valid for flights, dates and times shown. Name changes to the flight seats once confirmed are not permitted;
- Return domestic airport transfers and airport transfers whilst in New Zealand are not included;
- The winner and their guest will require passports valid for at least 6 months on date of travel. Any necessary visas, vaccines or travel insurance are the responsibility of the winner and their guest;
- All elements of the Prize package must be taken as part of the same trip;
- The Prize does not include excess baggage, car parking charges, meals or drinks, additional excursions and attractions, additional nights and services at the hotel, return transport to the test match or any other costs of a personal nature not stated, all of which will be the sole responsibility of the winner and their guest; and
- The winner is responsible for the behaviour of themselves and their guest whilst enjoying the Prize. The Promoter reserves the right in its absolute discretion to exclude the winner and/or their guest from participation in the Prize if the winner and/or their guest fail to comply with the directions of the Promoter or any companies associated with the Prize or the winner and/or guest act in a manner that is dangerous to themselves or to the public or is anti-social in any manner or which causes a disturbance or nuisance to others. 11. There are also 25 replica British & Irish Lions rugby jerseys to be won as runner-up prizes (“the Runner-up Prize”). The size required must be selected as part of the entry process.
- The Prize and the Runner-up Prize is not transferable or exchangeable unless otherwise stated. Non-cash elements of the Prize cannot be redeemed for cash or any other form of compensation. In the event for any reason the winner chooses not to take any element of the Prize at the time stipulated by the Promoter, then that element of the Prize will be forfeited and there will be no cash or other alternative offered, unless otherwise agreed. If due to unforeseen circumstances the Prize is not available, the Promoter reserves the right to substitute another Prize, at its sole discretion, of equal or higher value. 13. Winner selection: All valid entries received by the Promoter during the Promotional Period will be entered into a prize draw to be conducted within 3 working days of the closing date. Failure to respond to communication via email or telephone by 10 May 2017 will result in the winner forfeiting the Prize / the Runner-up Prize
- Winner Notification: Winners will be contacted by Friday 5 May 2017 via post using the postal address provided to the Promoter upon entry and will be required to respond to confirm eligibility and acceptance of the Prize/Runner-up Prize by Friday 12 May 2017. In the event a winner does not respond to communications by Friday 12 May, the Promoter reserves the right to disqualify that winner and allocate that Prize/Runner-up Prize to an alternative winner selected in the same manner
Promotional Codes
- Promotional codes can only be found on promotional packs of Whyte & Mackay Blended Scotch Whisky, 70cl and 1 litre.10-digit promotional codes can be located on the back of the promotional neck collar of promotional packs.
- Only valid promotional codes will be accepted. All codes are subject to verification. Codes may not be sold or exchanged. Other manufacturer's references or printing errors do not constitute codes. Each valid promotional code can only be entered once.
- Please retain your promotional bottle and neck collar. We may ask you to refer to it if you experience problems claiming.
- If you are unable to read your promotional code on pack or have any enquires concerning the promotion, please contact us at [email protected]. Please note that this service is dedicated to responding to queries about this promotion only.
- If there is any reason to believe that there has been a breach of these Terms and Conditions, the Promoter may, at its sole discretion refuse to accept a claim. The Promoter will be the final arbiter in any decisions and these will be final and binding and no correspondence will be entered into.
- Limitations of liability: insofar as permitted by law, neither the Promoter nor the Promotional Parties assume any responsibility or liability for:
- Any incorrect or inaccurate code entry, or for any faulty or failed electronic data transmissions.
- Any unauthorised access to, or theft, destruction or alteration of codes at any point in the operation of this promotion.
- Communications line failure, regardless of cause, with regard to any equipment, systems, networks, lines, satellites, servers, computers or providers utilised in any aspect of this promotion.
- Inaccessibility or unavailability of the internet or the website or any combination thereof.
- Any injury or damage to participants or to any other person’s computer which may be related to or resulting from any attempt to participate in the promotion.
- Any damages or injuries due to the misuse of the Whyte & Mackay branded whisky glass or the user’s negligence or misconduct.
- In the event of circumstances outside the reasonable control of the promoter, or otherwise where fraud, abuse, and/or an error (human or computer) affects or could affect the proper operation of this promotion or the awarding of prizes, and only where circumstances make this unavoidable, the Promoter reserves the right to cancel or amend the promotion or these terms and conditions, at any stage, but will always endeavour to minimise the effect to participants in order to avoid undue disappointment.
- 23.. Claims should not be sent to the Promoter’s address. Any claims received at this address will not be entered into the draw.
General
- The Prize/Runner-up Prize depicted in promotional communications are for illustrative purposes only.
- Entrants must enter the Promotion using their legal name. The Promoter reserves the right to disqualify any entrant who uses multiple names and to require them to return any Prize/Runner-up Prize they may have won. The Promoter will verify the eligibility of entrants. The Promoter will require such information as it considers reasonably necessary for this purpose and a Prize/Runner-up Prize may be withheld unless and until the Promoter is satisfied with the verification.
- All entries must be made by the entrant themselves. Bulk entries made from trade, consumer groups or third parties will not be accepted. Incomplete or illegible entries, entries by macros or other automated means (including systems which can be programmed to enter), and entries which do not satisfy the requirements of these terms and conditions in full will be disqualified and will not be counted. If it becomes apparent that an entrant is using a computer(s) to circumvent this condition by, for example, the use of 'script', 'brute force', masking their identity by manipulating IP addresses, using identities other than their own or any other automated means in order to increase that entrant's entries into the Promotion in a way that is not consistent with the spirit of the Promotion, that entrant's entries will be disqualified and any Prize/Runner-up Prize award will be void. The Prize/Runner-up Prize allocated to winners who are subsequently disqualified may not be reallocated.
- Where a winner has been found to be in breach of any of these terms and conditions and in particular where a person is in breach of the entry restrictions, the Promoter may nevertheless still enforce its right to disqualify that person and require the return or reimbursement to the Promoter of any Prize/Runner-up Prize even where a Prize/Runner-up Prize has been awarded and/or actually provided to the entrant or Prize/Runner-up Prize winner in question.
- Obtaining time off work and/or study or related activities to participate in the Promotion and/or participate in the Prize will be the sole and absolute responsibility of each entrant.
- Insurance is not provided as part of the Prize/Runner-up Prize. It will be the winner's and their guest's responsibility to take out at their own cost all relevant insurance (including but not limited to health and travel insurance, insurance for theft, loss and damage) which may be required or prudent to be taken.
- Where the Prize involves cross border travel, the winner and their guest must have and maintain valid passports with expiry dates no less than six (6) months following the proposed dates of travel or such other duration as may be required by any relevant regulation. These passports, and their holders, must not be subject to any restrictions on their rights to travel to and from the applicable country. Passport control and in-country authorities may reserve the right to refuse entry to a winner and/or their guests. The Promoter shall not be responsible for ensuring a winner's ability to travel nor for any additional costs incurred should entry be refused.
- It is the responsibility of the Prize winner and any guest to check any travel advisories issued by a Government, to determine whether they wish to accept the risk of travelling to the destination. The Promoter will not be responsible for any loss or damage suffered by the winner or their guest arising out of their failure to follow any travel advisories issued by a Government. The winner and their guest must comply with and are responsible for obtaining any inoculation and health regulations required by any Prize destination country.
- The Promoter will not be liable or responsible for any loss or damage suffered by the Prize winner or their guest should the winner not redeem a Prize as a result of any Government travel warning or advisory applicable to the destination country or for any other failure on their part to travel. In particular, the Promoter shall have no obligation to substitute any alternative prize, cash equivalent or other compensation where a winner fails to redeem the Prize for any reason.
- The Prize winner and their guest must comply with the terms and limitations of airlines, other transport providers, and the venues involved in the provision of the Prize. In particular, they must comply with all health and safety guidelines and instructions and all applicable legal and regulatory requirements.
- The Prize winner acknowledges that once the Prize has been issued, the Promoter is not liable or responsible if all or any part of the Prize is cancelled, varied, postponed or rescheduled for any reason at any time. The Promoter shall be under no obligation to provide an alternative prize in such circumstances or to reimburse any incurred expenses by a winner or their guests as a result of winning or accepting the Prize.
- The Promoter accepts no responsibility for system errors or other issues that may result in disruption to lost, delayed or not received registrations or winner notifications.
- No responsibility is accepted for entries lost, damaged or delayed or as a result of any network, computer hardware or software failure of any kind. Proof of sending will not be accepted as proof of receipt.
- The Promoter makes no representation or warranty in relation to the Prize/Runner-up Prize provided. Except as specifically set out herein and to the maximum extent permitted by law, all conditions, warranties and representations expressed or implied by law are hereby excluded. To the fullest extent permitted by law, we hereby exclude and shall not have any liability to any entrant or prize winner in connection with or arising out of this Promotion howsoever caused, including for any costs, expenses, forfeited prizes, damages and other liabilities, provided that nothing herein shall operate so as to limit or exclude our liability for personal injury or death caused by our negligence or liability for fraudulent misrepresentation. For the avoidance of doubt, this paragraph shall also apply in respect of any prize provided by a third party provider.
- If for any reason the Promotion is not capable of running as planned for reasons including but not limited to tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the Promoter which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Promotion, the Promoter reserves the right (subject to any written directions given under applicable law) to disqualify any individual who tampers with the entry process and to terminate, modify or suspend the Promotion.
- If an act, omission, event or circumstance occurs which is beyond the reasonable control of the Promoter and which prevents the Promoter from complying with these terms and conditions the Promoter will not be liable for any failure to perform or delay in performing its obligation.
- Winners may be requested to participate in reasonable publicity arising from the Promotion with no further compensation.
- Any personal data relating to participants will be used solely for the purposes of this promotion by the Promoter and/or by any agent appointed by it to assist with running the promotion on behalf of the Promoter and will not be disclosed to a third party for any other purpose without the individual's prior consent. By entering this Promotion, you consent to the use of your personal data by the Promoter and/or any agent appointed by it to assist with running the Promotion for the purposes of administration of the Promotion (including publishing your full name and county and/or disclosing it to third parties on request if you are the winner) and any other purposes to which you have consented.
- By entering this Promotion, all participants will be deemed to have accepted and be bound by these terms and conditions.
- This Promotion is governed by Scots Law and participants submit to the exclusive jurisdiction of the Scottish courts.
- If any of these clauses should be determined to be illegal, invalid or otherwise unenforceable then it shall be severed and deleted from these terms and conditions and the remaining clauses shall survive and remain in full force and effect.
