By entering this promotion, entrants will be deemed to have read, understood and accepted these Terms and Conditions and shall be bound by them together with any other applicable promotional material.

Where there is any conflict or inconsistency between any other communications (including advertising or promotional materials) and these Terms and Conditions, these Terms and Conditions shall prevail.

 

  1. The promoter is Whyte and Mackay Limited, 4th Floor, St. Vincent Plaza, 319 St. Vincent Street, Glasgow, Scotland, G2 5RG (the “Promoter”).

 

  1. This promotion is open to all United Kingdom (England, Scotland, Wales and Northern Ireland) residents aged 18 years or over. For the avoidance of doubt, this promotion is not open to residents of the Channel Islands or the Isle of Man.

 

  1. Purchase necessary. Proof of purchase will be required to redeem prize. Please keep a copy of receipt and promotional packaging to claim prize.

 

  1. All entrants represent that they are of legal drinking age in the United Kingdom and the Promoter shall have the right to discard any entries at any time which are found not to satisfy this criterion.

 

  1. This promotion is not open to employees of the Promoter, their families, the Promoter’s agents, clients, suppliers, retailers, merchants or associates.

 

  1. This promotion opens at 00.01 am on 20/03/2018 and will close at 23:59 pm on 30/06/2018 (the "Promotional Period"). All entries must be received by the Promoter by 23.59 pm on 30/06/2018. Any entries received outside of the Promotional Period shall be automatically rejected.

 

  1. To enter, purchase a promotional 70 or 100 cl of Whyte & Mackay Blended Scotch Whisky complete with promotional neck tag from participating Tesco stores. To be entered into the prize draw to win a VIP weekend to the Edinburgh Festival Fringe 2018 visit www.whiskycompetition.co.uk (“the Website”) and input and submit the promotional code printed on the reverse of the promotional neck tag together with the requested personal details (the “Code Mechanism”). Proof of submission shall not constitute proof of receipt of an entry by the Promoter. One (1) VIP weekend shall be available to be won in total under this promotion.

 

  1. The prize draw will take place on 02/07/2018 involving all valid entries received during the Promotional Period. One Winner will be chosen at random under independent supervision and shall be notified via telephone by the Promoter on or before 04/07/18 with details on how to claim their prize. Selection of Winner shall be final and no correspondence shall be entered into. All reasonable efforts will be made to contact Winner, however, if a Winner has not responded to the Promoter’s communications by 3pm on 11/07/18 the Promoter shall be entitled to withdraw that Winner’s prize entitlement and award it to an alternative entrant. Winner’s name shall be available within 4 weeks of 04/07/2018 and enquiries should be made by way of a stamped address envelope sent to the Promoter’s address (above) marked for the attention of “Head of Blended Whisky Brands”.

 

  1. The prize shall consist of:

     a. One (1) pair of two (2) tickets for Winner and guest for one (1) performance at the Edinburgh         Festival Fringe 2018 (“the Qualifying Performance”) as further detailed in Clauses 11 and 12;

      b. Access for Winner and guest to Underbelly VIP bar area at the Edinburgh Festival Fringe 2018          as further detailed in Clause 15;

      c. Return train travel (standard class) for Winner and guest to Edinburgh Waverley Railway                  Station from any UK mainland railway station;

      d. Two (2) nights’ accommodation in an Edinburgh hotel for Winner and guest. Room shall be a            double room and shall include breakfast;

      e. A helicopter tour of Edinburgh on the day of the Qualifying Performance. No alternative dates          offered. Return travel between accommodation and helicopter departure point shall be included.

      f. £250 spending money.

 

Any insurance cover, travel documentation and authority to travel shall be the sole responsibility of Winner and guest. All food, drink, home transfers to and from departure station, additional travel (other than that outlined in Clause 9, above), living expenses or any other subsistence shall not be included in the prize and shall be for the sole account of the Winner.

 

  1. Guest to accompany Winner must be aged 18 years of age or older as at the date of the Qualifying Performance.

 

  1. Winner and guest must be available to travel to Edinburgh on any of Friday 3, 10, 17 and 24 August 2018. The Qualifying Performance shall take place on one of the following: Saturday 4, 11, 18 or 25 August 2018.

 

  1. The Promoter shall inform Winner of the date, time and specific Qualifying Performance after that Winner has been notified of their success in the prize draw. The date, time and specific Qualifying Performance as intimated by the Promoter shall be final. Neither Winner nor guest shall have any right to choose an alternative date or time of the Qualifying Performance nor substitute an alternative performance therefor.

 

  1. Winner and guest shall be solely responsible for ensuring that they arrive in plenty of time to board all booked transport to Edinburgh. For the avoidance of doubt, the only cost of transport which shall be met by the Promoter shall be the return train tickets to Edinburgh Waverley from any UK mainland rail station and return travel from accommodation to Helicopter departure point. The Promoter shall have no responsibility or liability whatsoever in the event that Winner and/or guest fail to timeously board (for any reason) any transport to be taken in connection with this promotion.

 

  1. Winner and guest shall be solely responsible for arranging and at their own cost all travel from/to Edinburgh Waverley Railway Station to/from their accommodation. Access to the Qualifying Performance shall be solely at the organiser’s discretion and the Promoter shall have no responsibility or liability whatsoever in the event that (i) winner and/or guest fails or is unable to attend the Qualifying Performance (for any reason) (ii) winner and/or guest is refused entry to the Qualifying Performance (for any reason); (iii) the Qualifying Performance is cancelled, rescheduled, oversubscribed and/or does not complete (for any reason).

 

  1. In addition to attendance at the Qualifying Performance, Winner and guest shall be entitled to access the Underbelly VIP bar area on the day of the Qualifying Performance. For the avoidance of doubt, all food and/or drink shall be for the sole account of the winner and/or its guest. Access to, and service at, the Underbelly VIP area shall be solely at the organiser’s discretion and the Promoter shall have no liability or responsibility whatsoever in the event that winner and/or guest is refused entry to, or service at, the Underbelly VIP bar area (for any reason).

 

  1. Only one entry into the prize draw may be made per person and per promotional bottle. Multiple entries shall be rejected and all entries must be made directly by the person entering. The Promoter reserves the right to exclude any and all entries made using script, brute force or other computer generated techniques or those not in line with the spirit of the promotion at the Promoter’s sole discretion.  

 

  1. The Promoter cannot accept any responsibility for a delayed or cancelled journey in any mode of transportation.

By entering this promotion, entrants will be deemed to have read, understood and accepted these Terms and Conditions and shall be bound by them together with any other promotional material.

Where there is any conflict or inconsistency between any other communications (including advertising or promotional materials) and these Terms and Conditions, these Terms and Conditions shall prevail.

 

  1. The promoter is Whyte and Mackay Limited, 4th Floor, St. Vincent Plaza, 319 St. Vincent Street, Glasgow, Scotland, G2 5RG (the “Promoter”).

 

  1. This promotion is open to residents of Scotland only aged 18 years or over.

 

  1. Purchase necessary.

 

  1. This promotion is not open to employees of the Promoter, their families, the Promoter’s agents, clients, suppliers, retailers, merchants or associates.

 

  1. This promotion opens on 12/03/2018 and will close at 23:59 pm on 21/03/2018 (the "Promotional Period"). Any entries received outside of the Promotional Period shall be automatically rejected.

 

  1. All entrants represent that they are of legal drinking age in Scotland and acknowledge and accept that the Promoter shall have the right to discard any entries at any time which are found not to satisfy this criterion.

 

  1. To enter the prize draw for a chance to win, simply purchase a Whyte & Mackay ball serve from the venue, complete the Entry Card with your Name, Date of Birth, Contact Number and Email, and post in the box provided. Entry into the Promotion shall be strictly on a whilst stocks last basis. Proof of submission shall not constitute proof of receipt of an entry by Promoter.

 

  1. Only one entry card shall be issued per person and per serve and only one entry into the prize draw may be made per person. Multiple entries shall be rejected and all entries must be made directly by the person entering. The Promoter reserves the right to exclude any and all entries not in line with the spirit of the promotion at the Promoter’s sole discretion.

 

  1. There are two prizes available to be won in total under this Promotion. One prize comprises:

 a. One (1) pair of tickets for Winner and guest for a show at the Glasgow International Comedy Festival 2018 on either 23rd or 25th March 2018 (the “Qualifying Performance”) as detailed below, and;

 b. £50 towards dinner (the “Contribution”) for Winner and guest at The Old Schoolhouse, 311 Woodlands Rd, Kelvingrove, Glasgow G3 6NG (the “Venue”) as detailed below.

 

  1. Selection of the Winners shall take place on 22/03/2018 involving all valid entries received during the Promotional Period. Winners shall be selected at random by Promoter. Winners shall be notified via telephone advising of their success and with details on how to claim their prize. All reasonable effort will be made to contact a Winner, however, entrants acknowledge and accept that if they are selected as a Winner but do not respond to the Promoter’s communications and/or claim their prize in accordance with the Promoter’s directions by 12 pm on 23/03/18 the Promoter shall be entitled to withdraw that Winner’s prize entitlement and award same to an alternative entrant.

 

  1. Selection of Winners shall be final and no correspondence shall be entered into. Winners’ name shall be available within 4 weeks of 22/03/2018 and enquiries should be made by way of a stamped address envelope sent to the Promoter’s address (above) marked for the attention of “Head of Channel Marketing”.

 

  1. The Winner and guest must be available to both attend the Venue to redeem the Contribution and attend the Qualifying Performance on both 23/03/2018 and 25/03/18. No alternative dates shall be offered. Winners shall be required to redeem both the Contribution at the Venue and the tickets for the Qualifying Performance on the same date, being either 23/03/2018 or 25/03/18. The Promoter shall inform Winners of the date on which the Contribution and tickets to the Qualifying Performance are to be redeemed following the Promoter notifying them of their success in the prize draw. The guest accompanying the Winner must be aged 18 years or older on the date of redemption of the Contribution and tickets to the Qualifying Performance.    

 

  1. The Contribution shall be redeemable by Winner and guest solely at the Venue and shall be subject to any terms and conditions the Venue impose in respect of the Contribution, together with the following terms:

 a. The Contribution shall be redeemable only at the Venue and only on the date specified by the Promoter.

 b. Winner must be accompanied by guest to enable redemption of the Contribution.

 c. Winner and guest must be over 18 years old on date of redemption of the Contribution and must be prepared to show Venue proof of identification if requested. Entry to the Venue shall be within the Venue’s sole discretion.

 d. Redemption of the Contribution is strictly subject to availability and shall be within the Venue’s sole discretion. Award of the Contribution does not guarantee a reservation.

 e. To validly redeem the Contribution, on arrival at the Venue the Winner must give a name matching that attributed to their winning prize draw entry, and the Contribution must be referenced. Failure to give the matching name and/or reference the Contribution on arrival at the Venue may result in winner and guest having no entitlement to redeem the Contribution in respect of any attendance at the Venue, at the Venue’s sole discretion.

 f. The Contribution cannot be redeemed in conjunction with any other offer or promotion at the Venue.

 g. The Contribution can be used as full or part payment for food and drink at the Venue but shall be redeemable in respect of the following:

 h. Winner and guest must purchase a minimum of one small plate/side and one full price main meal per person.

 i. Any balance remaining upon satisfaction of point (i) above shall be redeemable in respect of any food or drink available at the Venue as the Winner and guest see fit.

 j.Should the Winner and guest not exhaust the monetary limit of the Contribution on their visit, any remaining balance is non-exchangeable for cash and shall be automatically forfeited.

 k. Any balance due to the Venue upon exhaustion of the monetary limit of the Contribution (including any service charge or gratuity payable) shall be for the sole account of the Winner and guest.

 l. Purchases made using the Contribution are not refundable in cash.

 m. Redemption of the Contribution shall at all times be at the Venue’s sole discretion and the Promoter shall have no responsibility or liability whatsoever in the event that the Venue refuses entry to the Venue and/or redemption of the Contribution.

 

  1. The Winner and guest shall be solely responsible for arranging for all travel to and from the Venue together with all travel to and from the venue for the Qualifying Performance. The Promoter shall have no responsibility or liability in this regard.

 

  1. To redeem the tickets to the Qualifying Performance, Winner and guest must attend at the show, date, time and location specified by the Promoter where the Winner’s name shall be taken at the door. The name given by the Winner must match that attributable to their winning entry and both Winner and guest must be prepared to show photographic ID. The date, time, location and specific Qualifying Performance as intimated by the Promoter shall be final. Neither the Winner nor guest shall have any right to choose an alternative date or time of the Qualifying Performance nor substitute an alternative performance therefor.

 

  1. The pair of tickets to the Qualifying Performance do not include travel, accommodation, food or any other financial contribution by the Promoter. The Winner and guest shall be solely responsible for arranging and at their own cost all travel to the venue for the Qualifying Performance. Access to the Qualifying Performance shall be solely at the organiser’s discretion and the Promoter shall have no responsibility or liability whatsoever in the event that (i) the Winner and/or guest fails or is unable to attend the Qualifying Performance (for any reason) (ii) the Winner and/or guest is refused entry to the Qualifying Performance (for any reason); (iii) the Qualifying Performance is cancelled, rescheduled, oversubscribed and/or does not complete (for any reason).

 

  1. Entrants accept that the website(s) associated with this Promotion are offered on an “as is” and “as available” basis. The Promoter makes no warranties that the website(s) will be uninterrupted, timely, secure or error free, that defects will be corrected, or that the website(s) or the servers that makes them available are free of software viruses or bugs or other defects. The Promoter shall have no control over, and disclaims all responsibility and liability for, any content which entrants encounter or events which may occur as a result of any User’s use of the website(s) to the fullest extent permitted by law, and the Promoter shall not be liable for any damages or other losses of any type whatsoever incurred by Users as a result of their use of the website(s).

 

  1. All prizes issued under this promotion are strictly non-transferrable and must not be offered for resale.

 

  1. The Promoter cannot accept any responsibility for a delayed or cancelled journey in any mode of transportation.

 

  1. The Promoter reserves the right to amend, alter, vary, suspend or withdraw this promotion as the Promoter deems necessary in its absolute sole discretion. The Promoter shall have the right in its absolute sole discretion to substitute any prize with one of equivalent or greater value. The prize or its alternative must be accepted as offered. No cash alternative will be offered in whole or in part in connection with this promotion.

If there is any reason to believe that there has been a breach of these terms and conditions or incorrect, illegible, fraudulent or other invalid or improper information has been provided, the Promoter may at its sole discretion refuse to award any prize under this promotion to a winning entrant.

      

  1. By completing and submitting the information requested for participation in this promotion, entrants consent to the collection, use and disclosure of their personal information for the purposes of this promotion. The Promoter may disclose entrants’ personal information to its contractors and agents to assist in conducting this promotion or communicating with entrants. Only if an entrant has so elected, entrants consent to the storage of their personal information on the Promoter’s database and the Promoter may use this information for future promotion and marketing purposes regarding its products, including contacting the entrant via electronic messaging.

If any of these clauses should be determined to be illegal, invalid or otherwise unenforceable then it shall be severed and deleted from these terms and conditions and the remaining clauses shall survive and remain in full force and effect.
